O R D E R

The Criminal Original Petition is filed to transfer the investigation in proceedings Na.Ka.No.39/Kaa.Thu.Ka/Ka.Oo/2002 dated 01.02.2020 of the second respondent to the first respondent and file a status report.

2.When the matter is taken up for hearing today, the learned Government Advocate (Crl. Side) appearing for the respondent Police would submit that the proceeding in Na.Ka.No.39/Kaa.Thu.Ka/Ka.Oo/2002, dated 01.02.2020 was originally pending on the file of the second respondent and the summon was issued to the accused persons Viz., Nathiya and Sakthivel. After issuing summon, both the accused appeared and enquiry was conducted. During the enquiry, it was found that the very same complaint was also sent to superior officer and the Anti Land Grabbing Cell. Crl.O.P.(MD).No.3376 of 2020 the very same complaint is pending before the third respondent in Current Paper No.158/ALGSC/KRR/2019 dated 19.12.2019 and he had requested the second respondent not to take any further action. Based on which, enquiry done by the second respondent, has been closed on 14.02.2020. He would further submit that now the enquiry is pending on the file of the third respondent. He would further submit that if the petitioner and the accused appear in person, due enquiry will be conducted by the third respondent. 3.In view of the same, a direction is issued to the third respondent to complete the enquiry at the earliest preferably within a period of two months from the date of receipt of a copy of this order.

4.With the above observations, this criminal original petition is disposed of.
