Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a writ of Mandamus, directing the respondents 1 to 3 to refund the bid amount of Rs.1,15,00,000/- paid at time of E-auction held on 21.06.2018 and Rs.12,55,000/- paid on 29.11.2019 towards registration fee and stamp duty at the rate of 18% per annum from the date of receipt of money from the petitioner. 2. Learned counsel appearing on behalf of the petitioner made a submission that the petitioner is ready to cancel the sale certificate at any time as per the date and time fixed by the Bank.
3. Thus, the Bank is at liberty to fix the date and time with the Sub-Registrar for cancellation of Sale Certificate and on that date the petitioner shall cooperate and execute necessary documents for the purpose of completing the transactions.
