Criminal Original Petition filed under Section 482 of Criminal Procedure Code to direct the 1st Respondent to transfer the investigation in Crime No.68/2022 1/4
dated 24.11.2022 on the file of 2nd Respondent to any other higher officials or some other investigation agency to investigate the case under the supervision of the 1st Respondent within the stipulated period.
ORDER:- This Criminal Miscellaneous Petition is coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.R.M.Anbunithi, Additional Public Prosecutor for the Petitioners, and Mr.R.Anandharaj, Advocate for the respondent, this Court made the following order:
"This Criminal Miscellaneous petition has been filed to extend the time for further period of six months to complete the investigation and to file a final report as per the directions given by this Court by an order dated 28.03.2023 made in Crl.O.P. (MD).No.5132 of 2023.
2. The learned Additional Public Prosector appearing for the petitioner would submit that this Court directed the petitioners to complete the investigation within a period of five months by way of order dated 28.03.2023. Thereafter, the petitioners herein conducted investigation and there are so many bank accounts are involved in this case. The petitioners herein find it very difficult to collect the details of bank accounts and other particulars. Therefore, they are unable to complete the investigation within the time frame as fixed by this Court by an order dated 2/4
28.3.2023. Therefore, he prays to extend the time for further period of six months to complete the investigation.
3. The learned Counsel appearing for the respondent/Defacto-complainant strongly opposed to extend the time, because this Court granted sufficient time to complete the investigation through an order dated 28.03.2023. Moreover, almost two years completed, still the investigation has not been completed. Hence, he strongly opposed to extend the time.
4. Considering the representations made by the both side counsels and the nature of offence and delay on the part of the petitioners are unavoidable. Therefore, it is appropriate to grant further period of three months time to complete the investigation file final report. Accordingly, further period of three months is granted to the petitioners to complete the investigation. It is made clear that no further extension will be granted. Accordingly ordered.
