ORDER : The Court made the following order :- The petitioner / Accused who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 74, 77, 318(2), 308(2), 351(3) of BNS and 66E, 67A of IT Act, in Crime No.19 of 2025 on the file of the respondent police, seeks anticipatory bail,

The prosecution alleges that the petitioner forcibly made the de facto complainant consume alcohol and ganja and, while she was not in a sound mental state, secretly took obscene photographs and videos of her without her consent. It is further alleged that when she questioned his actions, the petitioner threatened to upload the said photographs and videos on social media unless she paid him money, thereby demanding money and blackmailing her. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any stringent conditions that may be imposed by this Court. Hence, he seeks anticipatory bail. 2/4

4. The learned Government Advocate (Crl.Side) submitted that the petitioner has involved in very serious offence and the investigation is still pending. Hence, he strongly objected to the grant of anticipatory bail to the petitioner.

5. Taking into consideration the facts and circumstances of the case, the nature and gravity of the offence and the investigation is still pending. Further, if the petitioner is released on anticipatory bail, he may threatened the defacto complainant and abscond. Hence this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
