PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st respondent to process and issue the renewed passport of the petitioner bearing Application No. TR2077044621124 dated 21.10.2024 forthwith, without insisting upon any further explanation relating to FIR No.523 of 2020 on the file of 3rd respondent Police Station, Pudukkottai District.

ORDER

The present writ petition has been filed seeking a mandamus directing the first respondent to renew the passport of the writ petitioner based upon his application dated 21.10.2024 and the explanation offered to the criminal case as against the petitioner.

The learned Government Advocate(crl.side) appearing for the second and third respondents brought to the notice of the Court that the petitioner has been implicated in a criminal case in Cr.No.523 of 2020, on the file of the third respondent police and a charge sheet has been laid after a period of 6 years, i.e., only on 08.02.2026, through e-filing before the learned Judicial Magistrate No.I, Pudukkottai. Though the charge sheet was made ready in the year 2021, only after the writ petition came to be filed, the present charge sheet has been laid through e-filing before the concerned trial Court. 2/4

Considering the fact that the criminal case arose out of property dispute and so far the trial Court has not taken cognizance of the above said offence, the first respondent is directed to consider the request of the petitioner and pass orders within a period of 4(four) weeks from the date of receipt of a copy of this order.

4. With the above said observations, this writ petition stands disposed of. No costs.
