O R D E R

This Writ Petition has been filed seeking a direction to forbear the respondents from restraining the petitioner from using the pathway through Survey Nos.188/27 and 187/1A situated at Palayam Village, Gujiliamparai Taluk, Dindigul District, and to allot a pathway to enable the petitioner to access his cultivating patta lands in Survey Nos.188/29 and 188/31, situated in the same village and taluk, based on his representation dated 07.01.2026.

2. The learned counsel appearing for the petitioner would submit that Survey Nos.188/27 and 187/1A originally belonged to the petitioner and were subsequently acquired by respondent Nos.2 and 3 for the 2/5

purpose of extension of the railway track. It is submitted that the third respondent has now blocked the said pathway and is proposing to construct a compound wall. In the event such a compound wall is put up, the petitioner would have no access to his cultivating lands except through the said pathway. Therefore, the petitioner submitted a representation to the respondents seeking permission to use the pathway to access his lands. However, the said representation has not been considered till date.

3. The learned Central Government Standing Counsel appearing for the third respondent submitted before this Court that there is no proposal to construct any compound wall in the said land and that the petitioner need not entertain any apprehension in that regard.

4. In view of the above submission, the learned counsel for the petitioner requested that the statement made on behalf of the third respondent may be recorded and appropriate orders be passed.

5. Accordingly, the submission of the learned Central Government Standing Counsel is recorded. It is made clear that, in the event any 3/5

compound wall is put up in future, sufficient access shall be ensured to enable the petitioner to reach his land adjoining the land already acquired by the third respondent.

5. With the above observation, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
