PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 1st respondent to dispose the petitioner's appeal dated 16.09.2008 within stipulated time as may be fixed by this Court.

O R D E R

This Writ Petition has been filed for the issue of writ of mandamus directing the first respondent to dispose of the appeal filed by the petitioner on 16.09.2008 wihtin a time frame fixed by this Court.

2. Heard the learned counsel appearing on behalf of the petitioner and the learned Additional Government Pleader appearing on behalf of the respondents.

3. The petitioner was issued with the Stamp Vendor License by the second respondent in the year 1993. By virtue of the same, the petitioner was selling stamp papers before the Sub Registrar Office, Aravakurichi. The second respondent through proceedings dated 01.08.2008 cancelled the Stamp Vendor License. Aggrieved by the same, the petitioner filed an appeal before the first respondent. Since the same was not considered, the present Writ Petition has been filed before this Court.

4. Taking into consideration the facts and circumstance of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the first respondent to deal with the appeal filed by the petitioner on 16.09.2008 on its own merits and in accordance with law and pass appropriate orders within a period of six (6) weeks from the date of receipt of a copy of this order. The petitioner is directed to make a fresh representation along with all the relevant documents and also a copy of this order.

5. This Writ Petition is disposed of with the above directions. No costs.
