O R D E R

The Managing Director of the Operational Energy Group India Limited, Tuticorin has filed this writ petition as against the award passed by the Labour Court, Tirunelveli, in I.D.No.82 of 2017, dated 07.11.2020.

2.The respondent herein, an erstwhile employee of the petitioner Company, has raised the above Industrial Dispute, before the Labour Court, Tirunelveli as against the order of dismissal. The Labour Court, Tirunveli, by its order, dated 07.11.2020 has set aside the order of dismissal, however, considering that at the time of passing the order, the Company was wound up, the Labour Court has passed an award, directing the petitioner Company to pay a sum of Rs.3,50,000/- to the respondent together with interest at the rate of 7.5%, from 01.09.2017 till the date of payment and the same is under challenge in this writ petition.

3.The learned counsel appearing for the petitioner Company submits that the Company itself has been wound up even in the year 2017 and therefore there is no source for the company to pay the amount as directed by the Labour Court. 4.Considering the aforesaid submission, this Court referred the matter to the Mediation Centre attached to this Court and also appointed Mr Karthik, learned counsel, who is having some experience in the mediation as a Mediator.

5.Today(17.11.2025), when this writ petition is taken up for hearing, the learned counsel on either side along with the Mediator reported that the matter has been amicably settled between the parties and the respondent employee has agreed to waive off the interest portion and he has agreed to receive a sum of Rs.2,50,000/- instead of Rs.3,50,000/- as directed by the Labour Court. A Joint Compromise memo has also been placed before this Court to that effect. As per the Joint Compromise memo, a sum of Rs.2,50,000/- 3/6

as agreed by the employee/respondent has been settled to him, by way of a demand draft bearing No.004473, dated 14.11.2025. 6.Recording the joint compromise memo, dated 17.11.2025 and placing appreciation to the learned counsel for the petitioner, respondent and the Mediator for their best efforts to solve the issue between the parties, this writ petition is closed as no further order is required. The Tamil Nadu Mediation and Conciliation Centre, Madurai Bench of Madras High Court is directed to pay the applicable remuneration to the Mediator in this case. No costs. Consequently, connected Miscellaneous Petition is also closed.
