RESPONDENT/ACCUSED No.1& 2 IN CRL MP(MD) No.6784 of 2017 IN CRL OP(MD) No.5316 of 2017 Petitions praying that in the circumstances stated therein and in the petitions filed therewith the High Court will be pleased to extend the time to complete the investigation in Crl.O.P(MD).
No.5316/2017 and 5317/2017 dated 27/04/2017 and to file final report for furthermore three months for the said reasons respectively.
Order : These petitions coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.A.RAMAR,ADDITIOANL PUBLIC PROSECUTOR, Advocate for the petitioner in both the petitions the court made the following order:- These petitions are filed to extend further time to complete the investigation in Crl.O.P(MD)No.5316 of 2017 dated 27.04.2017.
2.The learned Additional Public Prosecutor appearing for the respondent Police submitted that the accused, by creating a fabricated and false documents,had obtained bank loan and two accused are still absconding and further, the bank loan was sanctioned on the basis of the legal opinion issued by an Advocate and he was enquired and a statement was also obtained from him. He further submitted that the original documents are under the custody of DRT and hence, he seeks further 3 months time to complete the enquiry as per the direction given by this Court in Crl.O.P.(MD)No.5316 of 2017 on 27.04.2017. 3.Considering the facts and circumstances of the case and considering the reasons assigned in the affidavits filed in support of these petitions, 3 months time is granted to complete the investigation from the date on which the order copy is made ready. These petitions are ordered accordingly.
