PRAYER: Writ Miscellaneous Petition is filed under Article 226 of the Constitution of India, seeking to issue a Writ of Certiorarified Mandamus to call for the records pertains to Public Auction Sale Notice dated 06.01.2026 issued by the 1st respondent who appointed under the Multi-state Co-operative Societies Act 2002 in pursuant to attachment proceedings in EP No.7 of 2024 in ARC No.41 of 2022 and quash the same as unlawful and unsustainable and consequently direct the respondents for fixation of fair market value of all the secured properties of petitioners and ensure proportional recovery if at all.

ORDER

This writ petition has been filed challenging the impugned Public Auction Sale Notice dated 06.01.2026 issued by the first respondent, who was appointed under the Multi-State Co-operative Societies Act, 2002, pursuant to the attachment proceedings in E.P. No.7 of 2024 in A.R.C. No.41 of 2022, and seeking a consequential direction to the respondents to fix the fair market value of all the secured properties of the petitioners and to ensure proportional recovery, if at all.

2. This Court, vide order dated 05.02.2026, had granted an interim order of stay on condition that the petitioner shall deposit a sum of Rs.3,00,000/-. However, when the matter was taken up for hearing, the learned counsel for the petitioner submitted that, despite the interim order granted, the petitioner did not deposit the said sum.

3. The learned Standing Counsel appearing for the respondents submitted that the auction did not take place since no bidder participated in the auction.

4. In the light of the above, nothing survives for consideration. Accordingly, this writ petition stands dismissed. No costs.
