Prayer: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, to direct the respondents 1 to 4 to take appropriate action for removal of the compound wall constructed around S. Nos.86, 87, 112 and 131 of Vijayaraghava Mudhaliyar Chathram Village, Palayamkottai Taluk, Tirunelveli District by restoring the flow of irrigation water from Pirayankulam situated in S. No.112/2 as well as restoring the cart track for the usage of the general public, on the basis of the petitioner's representation dated 06.01.2026 within the time frame as may be fixed by this Court. ORDER
Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for R1 to R4. Issuance of notice to R5 is dispensed with.
2. The petitioner asserts that the fifth respondent had put up a compound wall in the petition mentioned survey numbers and thus, committed encroachment.
3. When the matter was taken up for hearing, the learned Additional Government Pleader submitted that the fifth respondent had put up compound 2/4
wall only in S.No.86/1 which is a patta land. It is categorically stated by the official respondents that the fifth respondent had not committed any kind of encroachment. Written instructions have been issued to that effect by the Tahsildar, Palayamkottai.
