ORDER
This Writ Petition has been filed seeking a Writ of Mandamus directing the second respondent to sub divide the petitioner's property in S.No.86/1A1B of Vijayaraghava Mudhaliyar Chathram Village, Palayamkottai Taluk, Tirunelveli District and consequently, issue separate patta on the basis of the petitioner's representation dated 06.01.2026 within the time frame as may be fixed by this Court.
2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
3. Since no adverse orders are going to be passed against the third respondent, notice to the third respondent is hereby dispensed with.
4. The learned counsel for the petitioner would submit that the petitioner and one K.Yesudurai are the lawful owners of the subject property and continue to be in possession and enjoyment thereof. Though the petitioner submitted representations dated 29.12.2025 and 06.01.2026 to the respondents seeking
subdivision and to issue separate Patta, no action has been taken till date, compelling the petitioner to file the present Writ Petition.
5. The learned Special Government Pleader appearing for the respondents 1, 2 and 4 would submit that the petitioner's representations dated 29.12.2025 and 06.01.2026 will be considered and appropriate orders will be passed on merits and in accordance with law within a time frame to be fixed by this Court.
6. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the second respondent to consider the petitioner's representations dated 29.12.2025 and 06.01.2026, and pass appropriate orders on merits and in accordance with law, after affording an opportunity of hearing to all the necessary parties, within a period of twelve weeks from the date of receipt of a copy of this order. Needless to state that in the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court. There shall be no order as to costs.
