ORDER

Heard Mr. V.Balaji, learned counsel appearing for the petitioner and Mr.R.Baskaran, learned Additional Advocate General Assisted by Mr.R.Satheesh, learned Standing Counsel appearing for the respondents.

2. The learned counsel for the petitioner would submit that the petitioner is not an employee out of 90 workers, who have been charged for the loss caused to the respondent Corporation, no amount was recovered from him, as such relieving the petitioner from the work vide impugned order, dated 25.01.2025 is illegal.

3. The learned Additional Advocate General Assisted by Mr.R.Satheesh, learned Standing Counsel appearing for the respondents would submit that the petitioner is also one of the worker out of 90 workers against whom the charges have been levelled for the loss caused to the respondent Corporation. The respondents are contemplating to conduct detailed enquiry after issuing show cause notice to the petitioner and as such interference of this Court at this stage is not warranted.

4. Having considered the submissions of the respective learned counsels and upon careful perusal of the order impugned in this writ petition, it appears that the petitioner was relieved from paddy recruitment work vide impugned order. 2/4

Without passing any order of suspension or termination relieving him from the duty amounts to termination of the petitioner without conducting any enquiry or issuing any notice to the petitioner, which is impermissible under law and against the principles of natural justice.

6. Accordingly, there shall be an interim stay of the impugned order for a period of four weeks. The respondents are further directed to continue the petitioner in their Corporation.
