Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue Writ of Mandamus, directing the respondents to grant permission to conduct the peaceful Dharna at Theradi Thidal on 28.02.2021 in order to conduct the temple festival of Arulmighu Kottai Karuppasamy situated at Panchaalamkurichi by providing adequate police protection, based on the petitioner's representation dated 16.02.2021 submitted to the respondents through registered post within the time limit stipulated by this Court. By consent, this Writ Petition is taken for final hearing.

2. Mr.S.Chandrasekar, learned Additional Public Prosecutor, accepts notice for the respondents.

3. On the side of the petitioner, it is stated that there was an untoward incident during the year 2011 and 2012, but, there is no problem in conducting the temple festival at the present stage and prayed a writ of mandamus, directing the respondents to grant https://hcservices.ecourts.gov.in/hcservices/ 1/2

4.On the side of the respondents, it is stated that the temple festival was stayed from the year 2012 and the petitioners can approach the first respondent for getting permission for conducting the temple festival.

5.In view of the submissions made by both the parties, this Court directs the petitioner to approach the first respondent and to make a representation. On such representation, the first respondent is at liberty to decide the issue on the basis of the present situation prevailing in that area.

6.With the above direction, the Writ Petition is disposed of. No costs.
