PETITION FOR BAIL Under Section 439 of Cr.P.C. PRAYER :- For Bail in Crime No.1 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/accused, who was arrested and remanded to judicial custody on 08.02.2022 for the offence punishable under Section 7 of Prevention of Corruption Act, 1988 (Amendment Act 2018), in Crime No.1 of 2022, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner, who is working as Panchayat Secretary of Mettamalai Panchayat, demanded bribe of Rs.20,000/- in addition to fees of Rs.31,580/- from the defacto complainant and his wife with respect to grant of building approval to the defacto complainant's wife land. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution.

CRL OP(MD). No.3604 of 2022 4.The learned Additional Public Prosecutor would submit that the petitioner had demanded Rs.20,000/- from the defacto complainant for building approval and the amount was given to the petitioner has been recovered. He would further submit that investigation is pending.

5.Considering the seriousness and gravity of the offence alleged and also the fact that investigation is pending, this Court is not inclined to grant bail to the petitioner. 6.In the result, this Criminal Original Petition is dismissed. sd/- 22/02/2022 / TRUE COPY / / /2022 Sub-Assistant Registrar (C.S.)
