COMMON ORDER : The Court Made the following order :- The petitioners, who are arrayed as A2 and A1, in Crime No.241 of 2015 on the file of the respondent police, were arrested on 01.12.2015 for the alleged offences punishable under Sections 21(A)(B) Mines and Minerals Development Act, 1957 r/w 379 of I.P.C., and hence, seek bail.

2. The case of the prosecution is that on 30.11.2015 when the respondent police on conducting vehicle check-up, found a lorry bearing Registration No.TN 28- 6939 having 3 1⁄2 units of sand and on enquiry, it was found that they transported the sand without proper permit or records. 3.The case of the petitioner in Crl.O.P.(MD).No.24056 of 2015 is that the wife of the petitioner is the owner of the lorry. The case of the petitioner in Crl.O.P.(MD).No.24060 of 2015 is that the petitioner is the driver of the lorry and both the petitioners are in judicial from 01.12.2015.

4.The learned Government Advocate (Crl.side) submitted that the petitioners had transported 3 1⁄2 units of sand illegally. 5.Considering the facts and circumstances of the case and also considering the charges levelled against the petitioners that they have transported 3 1⁄2 units of sand without proper permit or records and the https://hcservices.ecourts.gov.in/hcservices/

same has been recovered and the petitioners are in judicial custody from 01.12.2015, this Court is inclined to grant bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II Karur and on further condition that the petitioners shall appear before the respondent police daily at 10.00 a.m., and 05.00 p.m., until further orders. sd/- 17/12/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
