ORDER

This Criminal Original Petition has been filed by the petitioner to direct the learned III Additional District Judge, Tirunelveli to expedite the trial and dispose of S.C.No.9 of 2010 within the time frame as fixed by this Court.

2. According to the petitioner, the petitioner is the victim in this case and the occurrence took place in the year 2009 but so far the case has not been disposed of. Already this Court directed the Trial Court to complete the trial within three months through an order, dated 20.09.2019 in Crl.O.P(MD)No. 13398 of 2017 but still the case is pending without disposal. Hence, the petitioner filed the present petition.

3. The learned Additional Public Prosecutor appearing for the respondent would submit that already trial in this case has been completed and the case is posted for arguments. Moreover, already this Court directed the Trial Court to complete the trial within three months through an order, dated 20.09.2019 in Crl.O.P(MD)No.13398 of 2017. Therefore, the present petition is not maintainable.

4. This Court had heard both sides and perused the materials available on record.

5. The prayer of the petitioner is to dispose the case in S.C.No.9 of 2010 on the file of the III Additional District Judge, Tirunelveli within the stipulated time. The petitioner himself admitted that already this Court directed the Sessions Court to complete the trial within three months through an order, dated 20.09.2019. Now after 5 years, still the case is pending. Though this Court already passed appropriate orders in the year 2019, the case has not been disposed of by the Trial Court. Considering the long pendency of the case and the case is now posted for arguments, this Court directs the Trial Court to dispose the case within a period of one (1) month from the date of receipt of a copy of this order.

6. With the above said observations and directions, this Criminal Original Petition stands disposed of.
