ORDER : The Court Made the following order :- This is an application for anticipatory bail. 2.On 27.01.2015, the above matter was posted to 29.01.2015, as there was no representation for the petitioner. On 29.01.2015 also, there was no representation. Hence, the matter was posted under the caption "for dismissal" on 30.
01.2015. On 30.01.2015, it was again adjourned to today i.e 02.02.2015 finally "for orders". Today also, the learned counsel for the petitioner seeks adjournment. 3.It is the case of the prosecution that the complainant's father namely Chellapan gave a loan of Rs.2,00,000/- at a rate of 2% interest to one Arumugam before 3 years. The above said Arumugam neither paid the principal amount nor paid the interest. So, Chellapan demanded to repay the amount. To escape from his liability, Arumugam lodged a false complaint against Chellapan. So, a case was registered against Chellapan under the Exorbitant Interest Act. For the above said case, Chellapan and his wife were arrested and subsequently, they have got bail. Thereafter, the above said Chellapan demanded the principal amount.
But the petitioner herein (Thangavel), Arumugam and one Muthulakshmi refused to repay the amount and made threatening to lodge false complaints and instigate to commit suicide. Pursuant to that, on 09.12.2014, Chellapan committed suicide. Before committing suicide, he wrote a letter for the reason of his suicide. After receiving the complaint, a case was registered under Section 306 I.PC in Cr.No.367 of 2014 against Thangavel, Arumugam and Muthulakshmi. 161(3) https://hcservices.ecourts.gov.
statements were also recorded from the witnesses and an inquest report was also prepared before the panchayatars at Government Hospital, Vedasanthoor.
4.In view of the serious allegations against the petitioner, it is not a fit case for grant of anticipatory bail. Hence, this anticipatory bail petition is dismissed.
