ORDER
This Writ Petition has been filed seeking a Writ of Mandamus to forbear the respondents from conducting any survey or measurement in respect of Survey No.3/28E, Usilampatti Village, Madurai District, including pursuant to the notice fixing the survey on 07.02.2026.
2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
3. The petitioner is aggrieved by the proposed survey sought to be conducted pursuant to the order passed by this Court dated 17.04.2025 in W.P.
(MD)No.10571 of 2025, filed by the sixth respondent herein. In the said writ petition, this Court directed the authorities to conduct a survey in respect of S.Nos.28A, 28C, 29A and 30A. Insofar as S.No.3/28E, which is the subject matter of the present writ petition, is concerned, the petitioner herein has already submitted a representation to the third respondent, and the same was directed to be disposed of after conducting an enquiry. It was further directed that, subject to the final orders to be passed by the third respondent, the survey application of the sixth respondent shall be decided within a period of twelve weeks.
4. Now, the petitioner has filed the present Writ Petition objecting to the said survey. This Court is of the view that the petitioner can agitate his grievance/objection in the course of the enquiry to be conducted, and the same shall form part of the records, after which appropriate orders shall be passed on merits and in accordance with law.
5. With the above observations, this Writ Petition is disposed of. No costs. NCC : Yes / No (K.SURENDER, J.) Index : Yes / No 06.02.2026
