PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order passed by the 1st respondent in Proceeding No. Nil dated 26.09.2025 and quash the same and illegal and consequently direct the 1st respondent to conduct the enquiry and issue fresh legal heirship certificate to the petitioner.

ORDER

The present writ petition has been filed seeking to quash the order passed by the first respondent herein on 26.09.2025, wherein the request of the petitioner for issuance of legal heir certificate for the death of her brother, namely, Vijayaveeran, has been rejected.

2. According to the learned Counsel appearing for the petitioner, the deceased Vijayaveeran has died as a bachelor. One of her sisters, namely, Elizabath, has stated that the deceased Vijayaveeran is a married person. In view of the conflicting reports emanating out of enquiry, the request of the petitioner for issuance of legal heir certificate has been rejected.

3. A perusal of the impugned order does not reflect any reason whatsoever except to the effect that the Revenue Inspector has not recommended. 2/4

In view of the above said facts, the order impugned in the writ petition is hereby set aside and the matter is remitted back to the file of the second respondent to pass a detailed order explaining the reasons for the rejection of the request of the petitioner for issuance of legal heir certificate.

5. With the above said observations, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is also closed. 09.02.2026 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR To
