PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus to call for the records relating to the impugned refusal check slip issued by the second respondent in his proceedings in RFL/GJ}h;/47/2022 dated 12.12.2022 and quash the same as illegal and consequentially to direct the second respondent to register the cancellation deed dated 12.12.2022 1/4

executed by the petitioner cancelling the power of attorney dated 06.12.2021 given by the petitioner in favour of the third respondent within the period that may be stipulated by this Court. ORDER

Challenge has been made against the impugned refusal check slip issued by the second respondent in his proceedings in RFL/GJ}h;/47/2022dated 12.12.2022 with consequential direction to the second respondent to register the cancellation deed dated 12.12.2022 executed by the petitioner cancelling the power of attorney dated 06.12.2021 given by the petitioner in favour of the third respondent

2. It is the grievance of the petitioner that when he presented the cancellation deed cancelling the power of attorney executed by him in favour of the third respondent, the same was refused to be registered. Hence, this petition has been filed.

3. It is reported on either side that the principal has died.

4. In view of the above, since the principal has died, the power of attorney would stand automatically cancelled. Therefore, nothing survives for further consideration in this petition and accordingly, the Writ Petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
