PRAYER:
To enlarge the petitioner on bail in Crime No.246 of 2014 on the file of the respondent police in connection with SC No.387/2024 on the file of the I Additional District and Sessions Judge, Tirunelveli.
ORDER : The Court Made the following order :- The petitioner/A-12, who is facing trial for the offences punishable under Sections 147, 148, 449, 302 and 506 (ii) IPC r/w 149 IPC in S.C.No.387 of 2024 on the file of the learned I Additional District and Sessions Judge, Tirunelveli in Crime No.246 of 2014 on the file of the respondent police, seeks bail. 1/3
2. The case of the prosecution is that the petitioner did not appear before the trial Court. Hence, Non Bailable warrant was issued on 18.02.2022 and pursuant to which, the petitioner was arrested on 28.07.2023.
3. Heard the learned counsel appearing for the petitioner.
4. The learned Additional Public Prosecutor appearing for the respondent Police would submit that ten previous cases are pending against the petitioner.
5. It appears that this is the second application for bail and the earlier bail application filed by the petitioner in Crl.OP(MD)No.20843 of 2023 was dismissed as withdrawn on 03.01.2024. Now, this application is filed by the petitioner without referring the change of circumstances to consider the case.
6. Considering the above facts and circumstances of the case and also considering the fact that there is no change in circumstances, this Court is not inclined to grant bail to the petitioner.
