The Petitioner herein seeks a direction to the second respondent to sub-divide the Petitioner's property situate at S.No.158/1, Plot No.64, Perungudi Revenue Village, Madurai South Taluk, Madurai District and to issue patta in favour of the Petitioner.
2.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 3.According to the Petitioner, the above mentioned property was purchased by him under registered sale deed, dated 6.3.2013 from one Venkateswaran. The vendor of the Petitioner got the property under Gift Settlement Deed executed by his mother Rajeswari on 5.2.2013. The said Rajeswari purchased the property from one Rathna under sale deed, dated 29.11.1993, The said Rathna purchased the property on 15.7.1994. Latter, the Petitioner came to know that the patta for the subject property was wrongly issued in the name of third respondent. Therefore he submitted a representation before the first respondent on 21.12.2022 seeking sub division of the property purchased by him and for issuance of patta by deleting the entry in favour of the third respondent. same has not been considered till date. Hence the Petitioner is before this Court with the present Writ Petition for the relief stated supra.
4.Mrs.K.Malathi, learned Additional Government Pleader who appears for the respondents 1 and 2 submit that the appropriate authority to consider the representation of the Petitioner to modify the revenue records is the Revenue Divisional officer, Thirumangalam and representation has not been submitted before him.
5.In view of the same, without going into the merits of the matter, the Petitioner is directed to submit a fresh representation before the competent authority namely, the Revenue Divisional Officer, Thirumangalam within a period of two weeks from the date of receipt of a copy of this order. On receipt of such fresh representation, the said authority shall consider the same and pass final orders on its own merits after issuing notice to the Petitioner, third respondent and other interested parties if any, within a further period of 12 weeks from the date of receipt of fresh representation from the Petitioner..
6.With the above directions, the Writ Petition stands 3/5
disposed of. No costs.
