ORDER : The Court Made the following order :- The petitioner/Accused No.2, who was arrested and remanded to judicial custody on 28.11.2015 for the alleged offences under Sections 294(b), 323 and 506(i) I.P.C. and Section 4 of TNPHW Act and Section 3 of TNPPDL Act in Crime No.784 of 2015 on the file of the respondent police and hence, seeks bail.
2. The case of the prosecution is that on 28.11.2015, the petitioner went to the house of the defacto complainant and abused her in filthy language and assaulted her and made criminal intimidation and thereby caused damage to the show-case of the defacto complainant to the tune Rs.10,000/- 3.The learned Counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and a false case has been registered as against the petitioner.
4. The learned Government Advocate (Crl.Side) submitted that the injured has already been discharged from the hospital and in the alleged occurrence, the petitioner caused damage to the tune of Rs.10,000/- .
5. The learned Counsel for the petitioner submitted that the petitioner is ready to deposit the sum of Rs.10,000/-. https://hcservices.ecourts.gov.in/hcservices/
6. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is directed to deposit a sum of Rs.10,000/-(Rupees Ten thousand Only) to the credit of Cr.No.784 of 2015 before the trial Court concerned and on such deposit, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.1, Kovilpatti and on further condition that the petitioner shall appear before the respondent police daily 05.30p.m. until further orders.
