ORDER

This Criminal Original Petition has been filed by the petitioner to direct the learned Judicial Magistrate, Tirumangalam to dispose of the case in C.C.No.23 of 2023 within the time fixed by this Court.

2. According to the petitioner, the petitioner is the de facto complainant in this case and based on the complaint given by the petitioner, the respondent police have registered a case and thereafter, the case is now pending for more than 5 years without any progress. Therefore, the petitioner seeks speedy trial.

3. The learned Additional Public Prosecutor appearing for the respondent would submit that the case is posted for trial and due to vacancy of the Presiding Officer, unable to conduct the case and the cases are being conducted by the Incharge Magistrate.

4. Considering the limited scope of the prayer sought for in this petition and the case is also pending for more than 5 years without any progress, it is appropriate to direct the Incharge of learned Judicial Magistrate, 2/4

Thirumangalam to dispose the case in C.C.No.23 of 2023 on the file of the Judicial Magistrate, Thirumangalam as early as possible without giving long adjournment and the respondent police is also directed to produce the witnesses without any delay.

5. With the above said observations and directions, this Criminal Original Petition stands disposed of.
