O R D E R

This writ petition is filed challenging the proceedings issued by the respondent herein in O.Mu.No.15238/E2/2024 dated 12.01.2024 and seeking consequential direction to the respondent herein to approve forthwith the promotion of A.Vasulingam, S.Kulandhai Thiras and N.Sampathkumar as Junior Assistants from 04.12.2023 onwards with salary and other attendant benefits.

2. The issue involved in the present writ petition is no longer res integra. The Hon'ble Division Bench of this Court as early as on 25.03.2021 in W.A.(MD).Nos.114 and 9 of 2020 had held that no prejudice would be caused to the respondent in disbursing the grant-inaid either in the post of Lab Assistant or in the post of Junior Assistant and directed the respondents therein to consider the promotion from Lab Assistant to Junior Assistant as recruitment by transfer and not by way of promotion.

3. The said judgement had been subsequently followed by this Court without any modification by various learned Judges. In view of the same, the order impugned herein is set aside and the matter is remitted back to the respondent to pass appropriate orders as held in the judgement of the Hon'ble Division Bench of this Court dated 25.03.2021 in WA(MD).Nos.114 and 9 of 2020. The said exercise shall be carried out within a period of eight weeks from the date of receipt of a copy of this order.

4. This writ petition is disposed of with the above directions. No costs.
