Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.S.MADHUSUDANAN, Advocate for the petitioner and of Mr.P.KOTTAICHAMY, Government Advocate(crl.side) on behalf of the Respondent, the court made the following order:- This petition has been filed to modify the order dated 03.01.2024 in Crl.O.P. (MD)No.23615 of 2023 as to appear before the Judicial Magistrate at Tiruchendur 1/3

instead of Judicial Magistrate, Sathankulam.

2.The learned counsel for the petitioner submitted that the defacto complainant's son is a practising Advocate at Judicial Magistrate, Sathankulam and the Bar Association had passed a resolution as against the petitioner by restraining the Advocates from appearing on behalf of the petitioner herein. Therefore, the petitioner is unable to execute sureties before the Judicial Magistrate, Sathankulam and thereby, the petitioner filed the present petition seeking modification of the said condition.

3.Considering the facts and circumstances of the case, the condition already imposed by this Court, dated 03.01.2024 is modified to the effect that the petitioner shall surrender and execute sureties before the learned Judicial Magistrate, Tiruchendur.
