PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st respondent to re-issuance of the petitioner's passport No.P1306611 on the basis of his online application to the 1st respondent vide application Ref. No.26-1049338043 dated 05.01.2026. 1/4

ORDER

The present writ petition has been filed seeking a mandamus directing the first respondent for reissuance of the passport to the writ petitioner based upon his application dated 05.01.2026.

The learned Government Advocate(Crl.side) appearing for the second respondent brought to the notice of the Court that the petitioner has been implicated in a criminal case in Cr.No.318 of 2023 on the file of second respondent which has culminated in filing of a charge sheet in S.T.C.No.391 of 2025, on the file of Judicial Magistrate No.II, Srivilliputhur. The petitioner has also been implicated in another criminal case in Cr.No.263 of 2024, on the file of the second respondent in which a chargesheet was laid on 05.08.2025 which is not yet taken on file.

3. Considering the above said facts, the petitioner is directed to approach the trial Court in S.T.C.No.391 of 2025 seeking permission of the Court to go abroad. In case if any such application is filed, the same shall be disposed of within a period of four weeks. Based upon the orders to be passed by the learned trial Judge, the first respondent is directed to proceed in accordance with law.

4. With the above said observations, this writ petition stands disposed of. No costs.
