ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 5(l) read with Section 6(1) of 1/4

Protection of Children from Sexual Offences Act, 2012 and Section 137(2) of BNS in Crime No.2 of 2026 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner and the victim girl were in a romantic relationship and had eloped from home on 29.09.2025, but later returned. In these circumstances, the petitioner and the defacto complainant communicated via social media. Subsequently, in January 2026, the petitioner went to the victim girl to propose marriage. While doing so, the petitioner harassed the victim girl. Hence, a case has been registered. 3.The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence. He seeks this Court to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) strongly opposed to grant anticipatory bail to the petitioner. Further, the petitioner has 7 previous cases among which 1 case is under POCSO Act.

5.After perusing the 164 statement and considering the facts and 2/4

circumstances of the case, the nature and gravity of the offence and the specific overt act against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.

6. Accordingly, this Criminal Original Petition is dismissed. 23.02.2026 TMG TO 1.The Inspector of Police, Manamadurai All Women Police Station, Sivagangai District.
