Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner/A3 in Crime No.26 of 2015 on the file of the respondent police, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 498(A), 406, and 506(i) IPC and hence, seeks anticipatory bail. 2.

The case of the prosecution is that marriage between the first accused and the defacto complainant was solemnized on 05.05.2004 and after marriage, the accused persons demanded dowry and harassed the defacto complainant and on her complaint, the case has been registered for the aforesaid offences.

The case of the petitioner is that the petitioner is the mother-in-law of the defacto complainant and she is innocent and she has not committed any offence and the marriage took place on 05.05.2004 and after 11 years of marriage with ulterior motive, she has given a false complaint. Immediately after the marriage, both the defacto complainant and the petitioner's son/A1 were living separately in the matrimonial home.

The learned counsel for the petitioner submitted that coaccused were granted anticipatory bail by this Court in Crl.O.P.(MD) No. 7443 of 2015 dated 17.06.2015 and he prays for anticipatory bail to the petitioner.

Heard the learned Government Advocate (Crl.side) appearing for the State.

Considering the facts and circumstances of the case, and considering the fact that the petitioner is the mother-in-law of the defacto complainant, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is https://hcservices.ecourts.gov.in/hcservices/

ordered to be released on bail in the event of arrest or on her appearance before Judicial Mahila Court, Magistrate level, Madurai, and on her executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C scrupulously.

7.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. sd/- 11/01/2016 / TRUE COPY / Sub-Assistant Registrar (C.S.)
