2. When the matter was taken up for hearing, the learned Government Advocate (Crl. Side) states that based on the undertaking given by the petitioner, the complaint against the petitioner was closed. If the respondent intends to register an First Information Report against the petitioner on the ground that the petitioner is not adhering to the undertaking, the respondent shall issue notice under Section 41 A of Cr.P.C. to the petitioner. This arrangement is directed so as to give breathing time to the petitioner to move this Court for the relief.
