Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, to direct the first and second respondent to return the petitioner's driving licence by considering the petitioner's representation dated 06.12.2017, within the time frame fixed by this Court.

O R D E R

Mrs.S.Srimathy, learned Special Government Pleader, takes notice for the respondents. By consent of both parties, the main writ petition is taken up for final disposal at the stage of admission itself.

2. The petitioner is working as a driver in Tamil Nadu State Transport Corporation Limited, Coonoor Branch, Nilgiri District. On 20.11.2017, the bus which he was driving met with an accident. In this regard Crime No.322 of 2017 was registered against the writ petitioner by the Inspector of Police, K.Paramathi Police Station, Karur District. The petitioner's driving licence has also been impounded. The criminal case is yet to progress. The final report has not been filed in this regard. The writ petitioner's driving licence cannot be impounded by the respondents. Therefore, this Court directs the first respondent to return the petitioner's original driving licence forthwith.

3. This Writ petition stands allowed accordingly. No costs.
