ORDER

This Civil Revision Petition has been filed challenging the order dated 09.10.2025 passed in I.A. No.1 of 2025 in O.S. No.116 of 2023 by the learned Additional District Judge, Ramanathapuram.

2. The revision petitioner is the defendant in the suit, who filed an application seeking rejection of the plaint. The trial Court dismissed the said application on the ground that the provisions of Section 80 of the Code of Civil Procedure had not been complied with at the time of filing the suit and that there was also undervaluation.

3. According to the revision petitioner, the suit has been maliciously instituted by the plaintiff. However, all these contentions involve triable issues, which can be adjudicated only upon a full-fledged trial. The trial Court has rightly held that the petition has no merit. 2/4

4. Challenging the same, the present Civil Revision Petition has been filed.

5. This Court is of the view that while dealing with an application for rejection of plaint, the Court has to confine itself to the averments made in the plaint and cannot embark upon a detailed examination of disputed facts. The issues raised by the revision petitioner require adjudication on evidence and cannot be decided in a summary manner.

6. In such circumstances, this Court finds no infirmity or illegality in the order passed by the trial Court warranting interference under revisional jurisdiction.

7. Accordingly, this Civil Revision Petition stands dismissed. Consequently, connected Miscellaneous Petition is closed. No costs. Speaking : Yes / No 10.02.2026 NCC : Yes / No Internet : Yes / No 3/4
