RESPONDENT/RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to pass an order to stay all the further proceedings in Crl.M.P.No.677 of 2017 in M.C.No.11 of 2015 pending on the file of the learned Additional Chief Judicial Magistrate, Madurai pending disposal of the Criminal Revision Petition.

Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.C.M.ARUMUGAM, Advocate for the petitioner and of Mr.K.C.RAMALINGAM, Advocate for the Respondent, the court made the following order:- The learned counsel for the petitioner and the learned counsel for the respondent are present and heard. The petitioner was directed to deposit a sum of Rs.50,000/- to the credit in M.C.No.11 of 2015 on the file of Additional Chief Judicial Magistrate, Madurai within a period of 4 weeks as per order dated 08.08.2017 by this Court. However, the petitioner has deposited only Rs.47,000/- before the Trial Court within the stipulated time. Hence, on 17.11.2017 this Court directed the petitioner to deposit the balance, amount of Rs.3,000/- on or before 22.11.2017.

The learned counsel for the petitioner submits that the petitioner has complied with the said condition and filed proof of deposit. He has no objection to withdraw the deposited amount by the respondent.

In view of the same, interim stay is made absolute. The respondent is permitted to withdraw the deposited amount by filing proper application.
