ORDER : The Court Made the following order :- The petitioners, who were arrested and remanded to judicial custody on 10.11.2015, for the alleged offences punishable under Sections 294(b), 341 and 302 IPC, in Crime No.490 of 2015 on the file of the respondent police, seek bail.

2.The case of the prosecution is that the first petitioner and the deceased are auto drivers and the petitioners jointly attacked the deceased on 09.01.2015 with wooden log and caused death.

3. The learned counsel for the petitioners submitted that the petitioners have been falsely implicated in this case and the deceased is the rowdy element having many previous murder cases and due to previos enmity, the deceased would have been murdered by some other person. He would further submit that the petitioner has been falsely implicated in this case.

4. The learned Government Advocate(Crl.side) would submit that investigation is at premature stage and investigation reveals that due to previous enmity the petitioners/A1 and A2 conspired together and they waylaid the deceased and attacked him with wooden log and the deceased died on the spot.

5.Taking note of seriousness of the offences charged against the petitioner and considering the fact that investigation is at earlier stage, this Court is not inclined to grant bail to the petitioners. Hence, this petition is dismissed.
