O R D E R

This writ petition has been filed to challenge the complaint ID MAT25049610 status updated in the official web portal of the TamilNadu Police and quash the same as illegal and consequently direct the respondent No.3 to conduct proper investigation on the complaint made by the petitioner on 30.01.2025 in accordance with law by considering his representation dated 04.02.2025.

2. The learned Counsel appearing for the writ petitioner would submit that the petitioner had lodged a complaint before the third respondent on 30.01.2025. Thereafter, the petitioner's complaint was closed and the same is reflected in the official website portal of the TamilNadu Police Department in ID MAT25049610. Thereafter, the petitioner sent a representation on 04.02.2025 and the same has not been considered. Therefore, he filed the writ petition to consider his representation dated 04.02.2025 and direct the 3rd respondent to conduct proper investigation.

The learned Additional Public Prosecutor appearing for the respondents No.1 to 3 would submit that already based upon the complaint of the petitioner a FIR has been registered in Crime No.5 of 2025. After investigation, charge sheet was filed. Since, already FIR has been registered, the present complaint dated 30.01.2025 has been closed through ID MAT25049610. Hence, he prays to dismiss the present writ petition.

4. Heard both sides and perused the materials available on record.

5. According to the petitioner on 30.01.2025, one Narendra Kumar was trespassed into the property of the petitioner and committed theft of articles used for putting up steel shed in the said lands. The respondent police have not properly enquired and they by referring the earlier complaint in respect of FIR in Crime No.5 of 2025, had closed the present complaint. The complaint dated 30.01.2025 in respect of trespass and theft has not been considered by the respondent police. In fact, the FIR in Crime No.5 of 2025 is for differents occurrence and the present complaint is for different occurrence. Therefore, this Court directs the 1 to 3 respondents to consider the complaint dated 30.01.2025, for the offence of Page No. 3 of 6

trespass and theft and to dispose the same on merits and in accordance with law within a period of one week from the date of this order.

6. With the above said observations, this writ petition is disposed of. No costs.
