PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the Respondent No.1 to re-issue a passport by processing the petitioner's application in File No.TR1075969909525 dated 07.01.2026 within stipulated time by this Court. ORDER

The present writ petition has been filed seeking a mandamus directing the first respondent to re-issue the passport to the writ petitioner based upon his application dated 07.01.2026.

2. The learned Government Advocate(crl.side) appearing for the second respondent brought to the notice of Court that the petitioner has been implicated in a criminal case in Cr.No.488 of 2021 on the file of the second respondent. Though charge sheet was made ready on 27.02.2021, so far it has not been taken on file.

3. The learned Government Advocate(crl.side) appearing for the second respondent also brought to the notice of the Court that the petitioner has been implicated in another criminal case in Cr.No.131 of 2024 which has culminated in filing of a charge sheet in S.C.No.482 of 2024 before the learned Judicial Magistrate, Pattukottai, in which fine was imposed upon the petitioner on 08.06.2024 and he has paid the fine.

4. In view of the above said facts, there is no legal impediment for the first respondent to consider the request of the petitioner for issuance of the passport.

5. Considering the above said facts, the first respondent is directed to consider the application of the petitioner and pass orders within a period of 4(four) weeks from the date of receipt of a copy of this order.

6. With the above said observations, this writ petition stands disposed of. No costs.
