Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for records pertaining to the online application order in TN-7202601052447 rejected by the respondents and quash the same as illegal and consequently direct the respondents to consider the petitioners application and issue legal heir certificate and pass such other or further orders as this Honble Court may deem fit and proper in the circumstances of this case and thus render justice. ORDER

The writ petition is filed for the following relief:- "Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for records pertaining to the online application order in TN-7202601052447 rejected by the respondents and quash the same as illegal and consequently direct the respondents to consider the petitioners application and issue legal heir certificate and pass such other or further orders as this Honble Court may deem fit and proper in the circumstances of this case and thus render justice."

2. Heard Mr.S.Vishnu Kanth, learned counsel appearing for the petitioner and Mr.D.Sadiq Raja, learned Additional Government Pleader, who takes notice on behalf of the respondents.

3. According to the petitioner, he has filed the above application for the issuance of a legal heir certificate with reference to the death of his mother. The petitioner has duly produced the death certificates of his father and mother, as well as the legal heir certificate of his father. In view thereof, the reasons stated in the impugned order cannot be sustained.

4. When the matter came up for hearing today, the learned Special Government Pleader appearing for the respondents submitted that only the online reply is under challenge and that if the matter is remanded, it can be reconsidered.

5. I have considered the rival submissions made on either side and perused the material records of the case.

6. It is seen that the petitioner has specifically contended regarding the deaths of his father and mother and the production of their death certificates, as well as the legal heir certificate of his father. In the said circumstances, the impugned order of rejection contains the following reasons:- "Deceased husband death genuine is not correct then deceased father and mother death not uploaded, hence rejected."

7. Firstly, it can be seen that it is incomprehensible to give any meaning for the same. Secondly, the petitioner also pleads that he has filed all the necessary documents.

8. In view thereof, the writ petition is allowed on the following terms:- i. The impugned order shall stand set aside and the matter is remanded back to the file of the 2nd respondent for fresh

consideration.

ii. The 2nd respondent shall consider the documents available and also issue notice to the petitioner and seek for any additional document, if further necessary.

iii. In any event, if the petitioner has provided the death certificate of his father and mother and when the affidavits of all the other legal heirs are produced before the 2nd respondent, there should not be any impediment for the 2nd respondent in issuing the legal heirship certificate.

iv. The said exercise shall be undertaken by the 2nd respondent and certificate shall be issued as expeditiously as possible, in any event not later than six weeks from the date of receipt of a web copy of the order, without insisting on the certified copy of the order.

v. No costs. Consequently, connected miscellaneous petition is closed.
