ORDER

This Criminal Original Petition has been filed to direct the learned Special Court for Exclusive Trial of SC/ST Cases, Madurai to consider the bail application of the petitioners and their surrender on the same day, if any petition filed by the petitioners in crime No.14/2026 on the file of the second respondent.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. Gist of the case: The third respondent has given a complaint as against the petitioners herein. The third respondent belongs to Schedule Caste, she is working as a Nurse in a private hospital, Madurai. The first petitioner and the third respondent were in love with each other. At that time, the first petitioner informed the third respondent that he is a 2/5

married man and living separately from his wife due to difference of opinion and he has also stated that he is going to get divorce from her. On that basis the 1st petitioner had physical relationship with the third respondent and also borrowed a sum of Rs.4,00,000/- from the third respondent. Later, the third respondent came to know that the 1st petitioner is living his wife and children, thereby he cheated the third respondent. Hence the complaint in Crime No.14 of 2026 has been registered for the offences under Sections 69, 296(b), 318(4), 351(2) of BNS and Section 3(1)(r), 3(1)9s), 3(1)(w)(i), 3(2)(va) of SC/ST (POA) Act, 1989.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby directs the learned Special Court for Exclusive Trial of SC/ST Cases, Madurai, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No.14 of 3/5

2026 on the file of the 2nd respondent police. The petitioner shall surrender before the learned Trial Court within a period of 15 days from the date of receipt of a copy of this order.
