ORDER
The case of the writ petitioner is that the lands in S.Nos.557/10, 557/14 and 557/15 at Nelkattumseval Revenue Village, Sivagiri Taluk, belongs to his ancestors and the same have been an enjoyment of the petitioner's family for several decades. The petitioner approached the second respondent for mutation of revenue records in his name in respect of subject property and at that point of time, he came to know that the sale deed has been executed in favour of one Kadal Konar and thereafter, patta also came to be issued in favour of said Kadal Konar. In order to cancel the said patta, the petitioner has filed an appeal before the first respondent/Revenue Divisional Officer on 27.06.2024. The said appeal is sought to be disposed of in the present writ petition.
2. The learned Additional Government Pleader appearing for the respondents would submit that the District Revenue Officer is the competent authority and the petitioner may be directed to approach the District Revenue Officer, Tenkasi for redressing his grievances. 2/4
3. In view of the above, this Writ Petition is disposed of in the following manner:- (i) The petitioner shall make an appeal before the District Revenue Officer, Tenkasi, within a period of two(2) weeks from the date of receipt of a copy of this order;
(ii) The Disrict Revenue Officer shall hold an enquiry with the parties including the petitioner, after issuing notice to the the person in whose name Patta presently stands, namely, Kadal Konar and after hearing his objections, the District Revenue Officer shall pass orders on the petitioner's appeal on merits and in accordance with law within a period of eight(8) weeks thereafter.
No costs.
