Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, to direct the respondents to record the name of the petitioner's present wife namely Mariammal in the service records particularly petitioner's pension records as nominee and to issue him an order mentioning Mariammal as his nominee with regards pension benefits under the TNSTC Employees Pension Fund in respect of the petitioner i.e. P.Murugan Special Grade Driver (Retired) EDP No. 20543 within a period that may fixed by this Court.

Heard the learned Counsel on either side.

2. By consent of both parties, the main writ petition is taken up for final disposal at the stage of admission itself.

3. The petitioner is a retired employee of the respondents Corporation. The petitioner's marriage with Vadakkuvaselvi ended in mutual consent divorce. The petitioner has enclosed a copy of the https://hcservices.ecourts.gov.in/hcservices/

divorce Decree dated 30.04.1999 in H.M.O.P.No.118 of 1998 on the file of the Additional Sub Court, Tirunelveli. Thereafter, the petitioner got married to Mariammal. The petitioner wants to include the name of the said Mariammal in his Service Records particularly in his pension records as nominee. Even though a request have been made in this regard, there is no response on the part of the respondents. Hence, this writ petition has been filed. No objection can be taken to the petitioner's request. Therefore, this Court directs the respondents 1 and 2 to include the name of the petitioner's present wife namely "Mariammal" in his service records including pension papers forthwith without any delay.
