This Writ Petition has been filed to direct the respondents No.1 to 4 to look into the petitioner's representation dated 30.01.2025 and forbearing the private respondents No.5 and 6 from conducting any meeting / function in the premises of Al Mohamadiya Pallivasal at New Mosque in the light of the decision order passed by 2nd respondent in Na.Ka.No.Aa2/15/2024, dated 13.08.2024.
2.Heard the learned counsel on either side and perused the materials available on record.
3.The learned counsel appearing for the petitioner would submit that due to misunderstanding between two groups in respect of 2/6
administration of Pallivasal, a peace committee meeting was convened and the 2nd respondent has passed an order, dated 13.08.2024 in Na.Ka.No.Aa2/15/2024. As per the order all the parties can worship peacefully, but no function or meeting be convened in the Pallivasal. However, R5 and R6 issued pamplets and notices that there will be a meeting in Pallivasal on 18.02.2025 and 23.02.2025. Hence, the petitioner sent a request to R1 to R4 on 30.01.2025, but no action was taken.
4.The learned Government Advocate appearing for the respondents 1 and 2 would submit that already they had conducted a peace committee meeting. As per the resolution passed in the meeting, no other meetings or functions to be held in the subject property, except worshiping the God. Further, the respondents have not received any representation for conducting meeting / function as alleged by the petitioner.
5.The learned Government Advocate (Crl.Side) appearing for the respondents 3 and 4 would submit that as per the resolution passed on the peace committee meeting, there is no restriction for 3/6
worshiping the God. However, no one can conduct a meeting / function in the premises. The respondents have also not received any representation to conduct meeting / function as alleged by the petitioner. Hence, this petition has been filed by the petitioner purely based on assumption. However, the representation of the petitioner will be considered by the respondents 3 and 4 within a period of 15 days. 6.In this case, it is an admitted fact that as per the resolution made in the peace committee meeting, all the parties can worship the God, but no one can conduct meeting / function. However, the petitioner sent a representation that functions would be held on 18.02.2025 and 23.02.2025 in the subject property. In this regard, he has also submitted that notices are also distributed among the public.
However, it is the strong contention of the respondents that they have not received any representation from anyone seeking permission to conduct meeting / function, as alleged by the petitioner. The respondent police also undertakes to consider the representation of the petitioner. 7.
the petitioner, the 4th respondent is directed to consider and pass appropriate orders based on the representation of the petitioner, dated 30.01.2025 within a period of one week, from the date of this order, on merits and in accordance with law.
8. With the aforesaid directions and observations, this Writ Petition stands disposed of.
