ORDER

This Criminal Original Petition is filed to direct the respondent police to file final report against the accused persons in Crime No.487 of 2020.

2. The case of the prosecution is that the petitioner is doing the business of iron gates in his village and he is in possession and enjoyment of 8 cents of land. During Covid-19 pandemic situation, he was not able to visit his property. Taking advantage of his absence, one Kadhar Batcha son of Syed Mohemed, Maluvendhi son of Oomaiyan and Rajendran son of Vellaichamy trespassed into his land and uprooted fence and caused damage to his agricultural products. Hence, he preferred a complaint before the Keelavalavu Police Station on 09.05.2020. The respondent assured that they will take action against the accused persons, if the Village Administrative Officer gives a letter.

The VAO also gave letter stating that the property is in possession and enjoyment of the petitioner for 20 years and the same was also submitted to the respondent police. Based on the assurance given by the respondent Police, the petitioner erected fence worth about Rs.40,000/-. The grievance of the petitioner is that the respondent police have neither arrest them nor file any final report. Hence, this present Criminal Original Petition is filed.

3. The learned Government Advocate(Crl.Side) submit that the https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.3037 of 2021 respondent police to complete the investigation and file the final report within a time stipulated by this Court.

4. Considering the above submission made by the learned Government Advocate (Crl.Side), the respondent police is directed to complete the investigation and file a final report within a period of two months from the date of receipt of a copy of this order.

5. With the above directions, this Criminal Original Petition stands disposed of.
