Mr.R.Meenakshi Sundaram Additional Public Prosecutor (Crl.Side) PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- For bail in Crime No.14 of 2025 on the file of the respondent-police. ORDER : The Court made the following order :- This Criminal Original Petition has been filed by the petitioner on 07.02.2025 under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) praying to grant bail.

The petitioner / accused no.1 was arrested and remanded to judicial custody on 11.01.2025 for the alleged offences punishable under Section 123 of Bharatiya Nyaya Sanhita (BNS), 2023 and Section 8(c) read with Sections 22(b) and 29(1) of the Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.14 of 2025 on the file of the respondent-Police.

3. The case of the prosecution is that on 10.01.2025, at about 06.00 p.m., based on secret information, the respondent-police, reached Ramalinga Park, Woraiyur, Trichy whereby, they found the petitioner and two others were in illegal possession of 25 small polythene packets each containing approximately 20 grams of Methamphetamine. The police arrested them and seized the Methamphetamine. Hence the case

4. Mr.R.Alagumani, the learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and he did not commit any offence as alleged by the prosecution. He therefore prays to grant bail to the petitioner.

Per contra, Mr.R.Meenakshi Sundaram, the learned Additional Public Prosecutor appearing for the respondent-police, submits that the petitioner and two other accused persons were in possession of 140 grams of magic mushroom, which is a commercial quantity. The petitioner has one previous case in Crime No.10 of 2025 2/4

on the file of the Kodaikanal Police Station. Hence, he prays to dismiss this Criminal Original Petition.

6. Heard on both sides. This Court has perused the records.

7. Considering the nature of offences alleged against the petitioner and also considering the involvement of the petitioner in another case in Crime No.10 of 2025 on the file of the Kodaikanal Police Station and considering the stage of the investigation i.e., nascent stage, this Court is not inclined to grant bail to the petitioner.
