O R D E R

This writ petition has been filed for a mandamus to direct the 2nd respondent to permit the petitioner to continue his service as Professor with all arrears and to hand over the petitioner's original certificates to the petitioner without insisting any payment.

2. The learned counsel for the petitioner would submit that the petitioner was appointed as Professor (English) in the year 2004. However, due to ill health, he availed medical leave for his surgery. Subsequently, when the petitioner approached the second respondent to allow him to join duty, he was denied and the petitioner was compelled to give resignation and therefore, the petitioner sent representation and since the same has not been considered, the petitioner approached this Court by filing W.P.(MD) No.21570/2016, wherein, liberty was granted to approach the authorities.

Pursuant to which, when the petitioner approached the authorities for allowing him to join duty and to hand over his certificates, the authorities demanded Rs.3,22,800/- which is not sustainable and hence, the petitioner is before this Court with this writ petition.

3. Heard the learned counsel for the petitioner and the learned standing counsel for R1.

Considering the facts and circumstances and without expressing any opinion with regard to the merits of the petitioner, this writ petition is disposed of with a direction to the 2nd respondent to consider the the representation made by the petitioner on 24.11.2019, and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
