For Respondent : Mr.R.Sivakumar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.58 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/sole accused, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 379 IPC r/w 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.58 of 2022 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner has illegally transported 1 1⁄2 unit of river sand. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case.

CRL OP(MD). No.3683 of 2022 4.The learned Government Advocate (Criminal Side) appearing for the respondent police would submit that the petitioner has transported 1 1⁄2 unit of river sand illegally. He would further submit that the petitioner is having five previous cases for similar offence.
5.Considering the seriousness and gravity of the offence alleged and also the fact that the petitioner is having five previous cases for similar offence as stated by the learned Government Advocate (Crl. Side), this Court is not inclined to grant anticipatory bail to the petitioner.
