ORDER
Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents 1 to 4.
2. The learned counsel for the petitioner submits that one Mr.s.Madhuram was selected as Correspondent to the School by the Managing Committee of the School and the change of correspondent is informed to the Education Department officials vide letter, dated 17.12.2024 by enclosing a resolution, dated 17.12.2024 of the Managing Committee. He contends that as per proceedings Dis.No.176724 B9/78, dated 17.10.1978, it will be enough if the department officials informed of the change of correspondent-ship by the Managing body, the department officers are precluded from interfering with the administrative matters, but the fourth respondent has issued proceedings, dated 03.02.2025 appointing the fifth respondent as Head Master, in charge, which is nothing but to interfere into the administrative matters of the School.
3. The learned Government Advocate appearing for the respondents 1 to 4 would submit that there is dispute between two persons for the post of correspondent in the said School and due to that reason, the school was temporarily brought under the direct payment. Now, to avoid any law and order problem and ensure the welfare of the students as the public examination is nearing, the fourth 2/4
respondent appointed the fifth respondent as Head Master, in charge and as such, there is no infirmity in the order, dated 03.02.2025 passed by the fourth respondent.
4. Considering the submissions of the respective learned Counsels and on careful examination of the order impugned in this writ petition, dated 03.02.2025, in the prima facie opinion of this Court, the said order is against the proceedings Dis.No.176724 B9/78, dated 17.10.1978 issued by the second respondent. Accordingly, there shall be an interim stay of the impugned order till further orders. sd/- 10/02/2025 / TRUE COPY / /02/2025 Sub-Assistant Registrar (C.S.
