O R D E R
This Criminal Original Petition has been filed by the petitioner to direct the 2nd respondent not to interfere in the civil dispute based on the petitioner's representation dated 06.01.2025.
2. According to the petitioner, there is a money dispute pending between the petitioner and the 3rd respondent. Already the 3rd respondent lodged a complaint before Sellur Police Station and the same was enquired and closed as money dispute. Again, the 3rd respondent lodged a complaint before the Commissioner of Police / 1st respondent herein and the same was forwarded to the 2nd respondent. Taking advantage of the said complaint, the 2nd respondent insisted the petitioner to settle the matter by interfering in the civil dispute. Therefore, the petitioner sent a representation dated 06.01.2025 to follow the Rule 562(2)(b) of the Tamil Nadu Police Standing Order and the Circular issued by the Additional Director General of Police in C.No.18/ADGP/L&O/Camp/2020 dated 09.01.2024, but the same has not been considered by the 2nd respondent. Therefore, he filed this petition.
3. The Government Advocate (Criminal) appearing for the respondents no.1 and 2 would submit that they have received the representation of the petitioner dated 06.01.2025, however the 3rd 2/4
respondent lodged a complaint before the 1st respondent and the same was forwarded to the 2nd respondent and now the 2nd respondent is conducting enquiry. The same 3rd respondent has already lodged a complaint before the Sellur Police station and the same was disposed of by directing the parties to approach the Civil Court. However, now the 2nd respondent has received the complaint forwarded by the 1st respondent and thereby, they will complete the enquiry within one week.
4. The 3rd respondent lodged a complaint as against the petitioner before the 1st respondent and the same was forwarded to the 2nd respondent and now the complaint is under enquiry and the petitioner has also appeared before the 2nd respondent and gave his statements. Therefore, considering the said circumstances, this Court directs the 2nd respondent to complete the enquiry and dispose the petitioner's representation dated 06.01.2025 within one week from the date of receipt of this order.
5. With the above said observation and direction, this Criminal Original Petition is disposed of. No costs.
