For Respondent : Mr.SS.Madhavan, Government Advocate (Crl.Side) PRAYER :-For Bail in Crime No.20 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner herein, who was arrested on 14.12.2021 for the alleged offences under Sections 363 and 506(1) of IPC and Sections 5 (1), 6, 7 and 8 of Protection of Child from Sexual Offences Act, 2012, on the file of the respondent Police seeks bail.

2. This is a second bail application. The petitioner is aged about 35 years having 2 children and the victim is only 16 years old. The victim was lured and sexually assaulted by this petitioner. Noting the gravity and nature of the offence committed by the petitioner, the earlier bail application was dismissed.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.

4. The learned Government Advocate on instructions would submit that investigation is completed and final report has been filed before the concerned Court.

5. The petitioner is in custody for more than 70 days and final report has been filed before the concerned Court. Considering the nature of offence committed by the petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. However, since final report has been filed, this petitioner is at liberty to approach the concerned Court for bail.
