No.8328 of 2016 dated 25.5.2016 from the respondent police station to the inspector of police cumbum south police station, Theni District.

Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S M.KAUSHIKAN, Advocate for the petitioner and of MR.K.ANBARASAN Government Advocate(Crl.Side) on behalf of the Respondents the court made the following order:- This petition is filed to modify the condition imposed by this Court in Crl.O.P(MD).No.8328 of 2016 dated 25.05.2016 from the file of the respondent Police to the Inspector of Police, Cumbum South Police Station, Theni District.

2. The learned counsel appearing for the petitioner submitted that due to the illness he did not appear before the respondent Police and seeks modification of the condition as stated above.

3. The learned Government Advocate (Crl. Side) submitted that already investigation is completed and charge sheet is filed and not taken on file.

4. Considering the fact that the investigation is completed and the charge sheet is filed, this Court is inclined to modify the

condition imposed by this Court that the petitioner shall appear before the concerned Court on all future hearings without fail.

5. Accordingly, this petition is ordered.
